Terms & Conditions

These Terms and Conditions ("Terms") govern access to and use of the Digital Cards Portal, the Events Portal, the BuildCost/BOQ Portal, and any other software, websites, APIs, or services provided by BOBTechWaves ("we", "us", "our", "the Company"), a technology business operating out of Dar es Salaam, Tanzania.

By having an account, making a payment, or otherwise using any BOBTechWaves service (collectively, the "Services"), you ("Client", "Customer", "you") agree to be bound by these Terms in full. If you are agreeing on behalf of an organisation, you confirm you have the authority to bind that organisation, and "you" refers to that organisation.

If you do not agree to these Terms, you must not access or use the Services. We may decline service to anyone at our discretion.

• "Services" means the Digital Cards Portal, Events Portal, BuildCost/BOQ Portal, and any associated websites, software, APIs, templates, or support we provide.
• "Client Content" means event details, guest/participant lists, images, text, and any other material you upload, submit, or provide to us.
• "Participant Data" means personal information about your event guests (name, phone number, email, invitation type) that you or we collect in connection with the Services.
• "Package" means a defined tier of Services (Bronze, Silver, Gold, or Custom) as described in Section 5.
• "Third-Party Providers" means external services we rely on to deliver the Services, including SMS gateways, WhatsApp messaging providers, email delivery providers, and payment processors.

Depending on the Package purchased, BOBTechWaves provides some or all of the following:

• Design and generation of digital cards from client-supplied event details and templates.
• Delivery of digital cards and messages via SMS, WhatsApp, Email, and/or phone call, using Third-Party Providers where applicable.
• Guest/participant list management, including import, editing, and status tracking.
• QR-code generation and check-in scanning tools for use at the event venue.
• Attendance confirmation phone calls made by our team, on Packages that include this service.
• Delivery and check-in reporting and analytics.
• Hosting of the Digital Cards Portal and related web applications during the subscription or engagement period.
• Where separately agreed and quoted, rental of the Digital Cards Portal for use under your own brand, or development of a custom platform for your organisation.
• Customer support as described in Section 11.

Delivery of messages via SMS, WhatsApp, and email depends on Third-Party Providers outside our control; confirmation phone calls are made directly by our team. We do not guarantee that every message or call will reach the guest, or that it will do so within any particular timeframe - see Section 12.

• You must provide accurate, current information when registering and keep it up to date.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must notify us immediately of any unauthorised use of your account.
• We may suspend or terminate accounts that provide false information, are used to violate these Terms, or are used for unlawful purposes.
• Accounts are personal to the registered user or organisation and may not be sold, transferred, or shared without our written consent.

BOBTechWaves offers a range of Digital Cards packages designed to support different event communication and guest management needs. Package prices are calculated per recipient/card, with no fixed limit on the number of recipients. The applicable price and services are those confirmed at the time of your order.

All prices are quoted in Tanzanian Shillings (TZS) per recipient/card, unless otherwise stated. Package prices, promotional offers, and included services may be updated from time to time. The price and Package confirmed when your order is accepted will apply to that order.

Any service requested beyond the selected Package - including additional delivery attempts, communication channels, printed materials, or other customised services - may attract additional charges. Any such charges will be communicated and agreed with you before the additional service is provided.

Accepted payment methods

• Mobile money (M-Pesa, Tigo Pesa, Airtel Money) via our payment processor.

• Late payment may result in suspension of the Services, including message delivery and card generation, without further notice.

You are responsible for any transaction fees, mobile money charges, or bank charges associated with your payment. Proof of payment must be sent to us where requested; we are not responsible for delays caused by payment processor errors outside our control.

• Deposits are non-refundable once work has commenced (including template design, portal setup, or list import).

By submitting Client Content, you grant BOBTechWaves a licence to use, reproduce, and display it solely to deliver the Services. You represent that you have the right to submit this content and the necessary consent to share Participant Data with us.

• Not attempt to reverse-engineer, resell, sub-license, or use the Services to build a competing product.
• Comply with all applicable Tanzanian law, including data protection and electronic communications legislation, in respect of any Participant Data you provide to us.

Our full data handling practices are set out in our Privacy Policy, which forms part of these Terms. In summary:

• We collect and process Participant Data (name, phone number, email, invitation type) solely to generate and deliver digital cards and manage event check-in on your behalf.

• Our total aggregate liability arising from or relating to these Terms or the Services is limited to the total amount you paid us for the Package giving rise to the claim.
• Nothing in these Terms limits liability that cannot lawfully be limited or excluded, including liability for fraud or wilful misconduct.

You agree to indemnify and hold BOBTechWaves harmless from any claim, loss, or expense (including reasonable legal fees) arising from: your breach of these Terms; Client Content or Participant Data you provide; your misuse of the Services; or your violation of any law or third-party right.

• We may suspend or terminate your access to the Services immediately, without refund, if you breach these Terms, fail to pay amounts due, or misuse the Services.
• You may stop using the Services at any time; this does not entitle you to a refund except as set out in Section 7.
• On termination, your right to use the Services ends immediately. We may retain or delete your data in accordance with our Privacy Policy and applicable law.
• Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.

We may update these Terms from time to time. Material changes will be indicated by updating the "Last updated" date above, and, where reasonably practicable, communicated to active Clients. Continued use of the Services after a change takes effect constitutes acceptance of the revised Terms.
